These Terms & Conditions ("Terms") govern your use of the Fayette Medical Supply, Inc. ("Company," "we," "us," or "our") website and online store (the "Services"). By using our Services, placing an order, or opting in to receive text messages from us, you agree to these Terms. If you do not agree, please do not use our Services.

By accessing or using our website, purchasing products through our online store, or otherwise engaging with our Services, you agree to be bound by these Terms and by our Privacy Policy. We may update these Terms from time to time; continued use of the Services after changes are posted means you accept the revised Terms.

You must be at least 18 years old, or the parent/guardian/caregiver of the person for whom equipment is being purchased, to place an order through our Services. You agree to provide accurate, current information when creating an order, requesting service, or contacting us, and to use the Services only for lawful purposes.

We work to describe and price products accurately, but errors may occur, product photos may show accessories sold separately, and pricing, availability, and specifications are subject to change without notice. Some items are marked "Call for current price" and are not available for direct online checkout — contact us for current pricing on those items. In the event of a pricing or listing error, we reserve the right to cancel or correct any affected order, and will notify you if that happens.

Online orders are processed and paid for through our third-party payment processor, Stripe. We do not store your full card details ourselves. Applicable sales tax is calculated automatically at checkout in accordance with Texas law.

Online orders currently ship to Texas addresses only. If you're outside Texas, please call us at 800-442-6704 to discuss options. Estimated delivery times are provided in good faith but are not guaranteed.

Certain equipment requires a valid prescription or physician's order before it can be dispensed, and some items may qualify as tax-exempt when purchased with a prescription for a named patient under Texas law. Where a prescription is required at checkout, your order will not be fulfilled until we receive and verify it. Texas sales tax may apply by default and be refunded once a qualifying prescription is verified — see our FAQ or contact us with questions about your specific order.

Returns and exchanges are handled on a case-by-case basis in accordance with the applicable manufacturer's policy and, where relevant, Medicare/insurance billing rules. For hygiene and safety reasons, certain used or unsealed items (such as bathroom safety and personal-care equipment) may not be eligible for return once opened. Please contact us at 800-442-6704 before returning any item so we can confirm eligibility and next steps.

Content on our website — including product descriptions, buying guides, and any tools such as our lift chair fitting guide — is provided for general informational purposes only and is not medical advice. It does not replace the judgment of your physician or other qualified healthcare provider. Always consult your provider regarding your specific medical needs before selecting or using home medical equipment.

Financing options such as CareCredit are offered by independent third parties and are subject to their own terms, credit approval, and conditions. We are not a party to and are not responsible for any financing agreement you enter into with a third-party lender.

All text, graphics, logos, and other content on our Services, other than manufacturer product photos and trademarks used to describe the products we sell, are owned by or licensed to Fayette Medical Supply, Inc. and may not be copied or reused without our permission.

You agree not to misuse our Services — including attempting to access non-public areas of our website without authorization, interfering with the operation of our Services, or submitting false information in an order, job application, or other form.

Our Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding our Services, including implied warranties of merchantability and fitness for a particular purpose. This does not affect any separate written warranty provided by an equipment manufacturer.

To the fullest extent permitted by law, Fayette Medical Supply, Inc. will not be liable for any indirect, incidental, or consequential damages arising from your use of our Services. Nothing in these Terms limits any liability that cannot be limited under applicable law.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

We may update these Terms periodically to reflect changes to our Services or for legal or operational reasons. The "Last updated" date at the top of this page reflects the most recent revision.
